Terms and Conditions
YAL Store — This document is governed by the Kuwaiti legal framework, including Emiri Decree Law No. 10/2026 on regulating digital commerce, Consumer Protection Law No. 39/2014, and the Kuwaiti Commercial Law.
Effective Date: April 30, 2026
Article (1): Definitions
1.1 "Store": The YAL website and all its digital channels.
1.2 "Seller": Three Partners Company, a Kuwaiti legal entity, engaged in digital commerce activities under a license issued by the Ministry of Commerce and Industry.
1.3 "Customer" / "User": Any natural or legal person who accesses the website or makes a purchase.
1.4 "Product": Any item offered for sale on the Store.
1.5 "Contract": The electronic sales contract concluded between the Seller and the Customer upon order confirmation.
Article (2): Acceptance of Terms
2.1 By using the website or completing a purchase, the Customer acknowledges reading and fully accepting these terms.
2.2 If the Customer does not agree to any of these terms, they must stop using the website.
2.3 The Customer undertakes to have reached the legal age of majority (18 years) or to use the website under the supervision of a guardian.
Article (3): Eligibility
3.1 The Customer must have full legal capacity to enter into a contract.
3.2 Minors are not allowed to make purchases except with the permission and approval of a guardian.
Article (4): Account Creation
4.1 The Customer undertakes to provide accurate and complete information upon registration.
4.2 The Customer is responsible for the confidentiality of their account data (username and password).
4.3 Any activity occurring through the Customer's account is considered to be originated by and the responsibility of the Customer.
Article (5): Products and Prices
5.1 All prices are displayed in Kuwaiti Dinars (KWD) and include VAT where applicable.
5.2 We are committed to displaying the final price before payment, including all fees and taxes as required by the Kuwaiti Digital Commerce Law.
5.3 The Store reserves the right to adjust prices at any time before order confirmation.
5.4 Displayed images may differ slightly from the actual product due to differences in lighting and screen settings.
5.5 In the event of a clear pricing error, the Store has the right to cancel the order and inform the Customer before shipping.
Article (6): Order Procedures and Acceptance
6.1 The contract is concluded immediately upon order confirmation through the system and the Customer's receipt of an email confirmation.
6.2 The Store has the right to refuse or cancel any order for objective reasons (out of stock, pricing error, suspicion of fraud) without stating reasons.
6.3 An electronic invoice is issued for each order in accordance with the provisions of the Digital Commerce Law.
Article (7): Payment
7.1 Payment methods licensed by the Central Bank of Kuwait are accepted:
- Visa / Mastercard / American Express cards
- K-Net (if available)
- Apple Pay / Google Pay (if available)
- Installments via Deema BNPL (if available)
7.2 All transactions are processed through licensed and secure payment gateways (e.g., MyFatoorah / Tap Payments).
7.3 The Store does not store bank card data on its servers.
Article (8): Shipping and Delivery
8.1 The Store undertakes to ship orders within Kuwait within 1-3 business days of payment confirmation.
8.2 Shipping is free for orders exceeding 30 Kuwaiti Dinars.
8.3 The Customer is responsible for providing an accurate address. Any delay due to an incorrect address is the responsibility of the Customer.
8.4 The Store is responsible for the product until it reaches the Customer, unless the Customer has requested shipment through a company of their choice.
Article (9): Returns and Exchanges
The return policy outlined on the "Return and Exchange Policy" page applies and is considered an integral part of these terms.
Article (10): Intellectual Property
10.1 All content on the website (texts, images, logos, designs, symbols) is the exclusive property of the Store or licensed to it.
10.2 It is prohibited to copy, distribute, or use any of this content for commercial purposes without prior written permission.
10.3 The "YAL" trademark is registered with the competent authorities in Kuwait.
Article (11): Website Usage
11.1 The Customer undertakes not to do any of the following:
- Use the website for illegal or harmful purposes.
- Attempt to hack or damage the website.
- Send viruses or malicious software.
- Impersonate another person.
- Collect other users' data without permission.
- Use automated systems to access the website (bots) without permission.
Article (12): Disclaimer and Limitation of Liability
12.1 The website is provided "as is" without any express or implied warranties.
12.2 The Store does not guarantee the continuous availability of the website without interruption or its freedom from technical errors.
12.3 The Store is not liable for any indirect or consequential losses.
12.4 The maximum liability of the Store to the Customer for any order shall not exceed the value of the order itself.
12.5 These limitations do not affect any non-waivable rights stipulated in Kuwaiti law.
Article (13): Force Majeure
The Seller shall not be liable for any delay or failure in performing its obligations due to events beyond its control (natural disasters, wars, strikes, general internet outages, government decisions).
Article (14): Termination
The Store has the right to terminate or suspend the Customer's access at any time if they violate these terms, without prejudice to any rights that arose before termination.
Article (15): Dispute Resolution
15.1 Any dispute shall be resolved amicably through direct communication with the Store.
15.2 If a resolution cannot be reached, the Digital Dispute Resolution Committee established under the Kuwaiti Digital Commerce Law shall have jurisdiction.
15.3 If the dispute is not resolved, the courts of Kuwait — Hawally Courts Department — shall have jurisdiction to hear the dispute.
Article (16): Governing Law
These terms and any contract arising thereunder shall be governed by the laws of the State of Kuwait.
Article (17): Amendments
17.1 The Store has the right to amend these terms at any time.
17.2 The updated version will be published on the same page with the new effective date.
17.3 The Customer's continued use of the website after the amendment constitutes implied acceptance of the new terms.
Article (18): Severability
If any provision of these terms becomes void or unenforceable by law, the remaining provisions shall remain in full force and effect.
